Court Approves Alternative Means to Serve Nsawam-Adoagyiri MP in Election Petition Case
The Koforidua High Court has authorized substituted service for Nsawam-Adoagyiri Member of Parliament (MP) Frank Annoh-Dompreh in an ongoing election petition filed by the National Democratic Congress (NDC). The petition challenges the results of the parliamentary election and seeks their annulment.
The NDC contends that the Electoral Commission’s declaration of results was flawed due to the exclusion of votes from several polling stations. According to the petitioners, this omission significantly affected the performance of the party’s parliamentary candidate, Selorm Philibert Fummey Amenorpe, and ultimately influenced the final outcome of the election.
Efforts to deliver court documents to MP Annoh-Dompreh in person proved unsuccessful. Given constitutional restrictions that prevent direct service on MPs while they are engaged in parliamentary duties, the court approved alternative methods to ensure he is properly notified.
Under the substituted service order, the writ will be publicly announced and displayed through the following channels:
- Nsawam-Adoagyiri High Court
- Koforidua High Court
- Fawe FM (a local radio station)
- Five community information centers in Nsawam-Adoagyiri
- Three key public notice boards in the constituency
- NPP Constituency Office in Nsawam-Adoagyiri
These measures will remain in place for 10 days, allowing sufficient time for the MP to acknowledge the legal action.
With this ruling, the election petition process progresses to the next stage. The case has been adjourned to March 14, 2025, when further proceedings will take place. The outcome of this legal challenge could have significant implications for both the Nsawam-Adoagyiri parliamentary seat and the broader electoral framework in Ghana.
