The Supreme Court has scheduled Wednesday, April 9, 2025, to hear a legal challenge regarding the procedure being used to potentially remove Chief Justice Gertrude Torkornoo from office.
The case, brought by Old Tafo MP Vincent Ekow Assafuah, disputes the constitutional process initiated by President John Mahama following three petitions seeking the Chief Justice’s removal.
Mr. Assafuah is requesting a ruling that the Chief Justice must be given an opportunity to respond to the allegations before the President engages in consultations with the Council of State, as outlined in Article 146(6) of the 1992 Constitution.
Represented by former Attorney-General Godfred Dame, the MP contends that failing to notify the Chief Justice in advance infringes on her right to a fair hearing and threatens judicial independence.
The Supreme Court will determine whether the President’s actions align with constitutional provisions for the removal of a Chief Justice.
